What Is CBD Oil?
Cannabidiol is a non-psychoactive chemical compound found in the cannabis plant, related to THC—it’s the component that gets you “high” in marijuana. But unlike THC, CBD oil does not make you high. The effects are therapeutic, not mind-altering. And, you won’t have to worry about testing “positive” for drug use at work.

CBD oil has anti-inflammatory properties, which makes it effective in treating ailments like Achilles tendonitis, inflammatory arthritis, skin irritations, musculoskeletal pain, and plantar fasciitis. Some people use a CBD oil stick in place of Bengay or Bio Freeze. You can also take CBD in pill, spray, lotion, or salve form.
“CBD, I personally believe, can replace almost any store drug,” said James Dinh of Cloud99 Vapes. “It can 100% replace Advil, ibuprofen, and all those things because it just makes your body work better,” he explains.
The reason CBD is so effective is that the body naturally has millions of cannabinoid receptors in the brain and nervous system, which react to hemp and marijuana-derived products. Is CBD Oil Legal in NYC?
As of 2018, CBD oil is still a bit of a gray area in New York State. If it’s derived from marijuana, it is illegal, unless you have a medical marijuana prescription. These scripts are available to people who suffer from one of 10 qualifying conditions:
- HIV or AIDS
- Spasticity / spine injury
- Huntington’s disease
Of these, neuropathies stands out, as we frequently treat people with peripheral neuropathy—mostly diabetics. Research shows CBD oil is effective at reducing muscle spasms, controlling cancer-related neuropathy when used as a spray, and improving HIV-related neuropathy pain in up to 50% of patients.
Most of the products you’ll see in NYC stores are hemp-derived CBD oil, which are legal in New York State.
The federal government still maintains that most CBD oil is technically illegal, as it has not been approved by the DEA or FDA. However, President Obama’s Farm Bill in 2014 protects hemp grown under state-regulated law. Governor Cuomo supports local hemp production as well, so you’re probably good.
According to DEA spokeswoman Barbara Carreno, all online sales of CBD products are technically illegal nationwide because they are classified as a Schedule 1 drug with “high abuse potential,” along with marijuana, heroin, LSD, and cocaine. Right now, the feds are only really looking at large-scale trafficking and store sales, and the priority plays second fiddle to the opioid crisis, so it seems many New Yorkers are hedging their bets. Despite the risk, it hasn’t stopped numerous shops in NYC from sprouting up, offering all sorts of CBD oil products or even CBD-infused edibles.
